DATA PROTECTION

Daimler Truck appreciates your interest in the company and its products and your visit to this website. Your privacy is important to us and we want you to feel at ease when visiting our site. The protection of your privacy when processing your personal data is an important concern to which we pay special attention in our business processes. Personal data collected during visits to our web pages are processed by us according to the legal provisions governing data protection as valid for the countries in which the web pages are maintained. Furthermore, our data protection policy complies with the Data Protection Code of Conduct applicable company-wide for Daimler Truck.

Collection and processing of personal data.
If you visit our website our web servers save information as standard, including about the browser and operating system you use, the website from which you are visiting us, the date of the visit and for security reasons, e.g. in order to detect attacks on our websites, and for the duration of seven days the IP address allocated to you by your Internet Service Provider. With the exception of the IP address, personal data are only stored if volunteered by you, for example, in the context of a registration, a survey, a contest or in execution of a contract.

Use and disclosure of personal data and purpose specification.
Daimler Truck will only use your personal data for the purpose of technical administration of the web page, customer administration, product surveys and marketing, and only to the extent necessary in each specific case. We will only disclose your data to governmental authorities in cases where it is required by national law. Our employees, agencies, and retailers are obliged by us to respect confidentiality.

Purposes of use.
a. We use the personal data collected when you visit our websites to make them as convenient as possible for you to use and to protect our IT systems from attacks and other illegal activities.

b. If you provide us with further personal data, e.g. as part of a registration, a chat, a survey, a competition or for the execution of a contract, we will use this data for the aforementioned purposes, for the purposes of customer administration and - if necessary - for the purposes of processing and billing any business transactions, to the extent necessary in each case.

c. Data collected in the contact form will be used to process your request and to contact you in connection with the request.

d. For other purposes (e.g. display of personalised content or advertising based on your usage behaviour), we and, where applicable, selected third parties use your data insofar as you give your consent (= agreement) to this within the framework of our consent management system. Further information and decision-making options have been listed here.

e. We also use personal data insofar as we are legally obliged to do so (e.g. storage for the fulfilment of commercial or tax-related legal obligations, disclosure pursuant to official or court order, e.g. to a law enforcement authority).

Legal basis for processing.
a. If you have given your consent to the processing of your personal data, this constituted the legal basis for the processing (Art. 6(1)(a) GDPR).

b. The legal basis for processing personal data for the purposes of initiating or fulfilling a contract with you is Art. 6(1)(b) GDPR.

c. Insofar as the processing of your personal data is necessary for the fulfilment of our legal obligations (e.g. for the retention of data), we are authorised to do so in accordance with Art. 6(1)(c) GDPR.

d. In addition, we process personal data for the purposes of exercising our legitimate interests as well as the legitimate interests of third parties in accordance with Art. 6(1)(f) GDPR. Maintaining the functionality of our IT systems, the (direct) marketing of our own and third-party products and services (insofar as this does not take place with your consent) and the legally required documentation of business contacts are such legitimate interests. Within the scope of the respectively required balancing of interests, we take into account in particular the type of personal data, the purpose of processing, the processing circumstances and your interest in the confidentiality of your personal data.

e. When contacting us using the online form, we obtain your consent to the processing of your data in electronic form. This forms the legal basis and the prerequisite for processing your data.

Deletion of your personal data.
We delete your IP address and the name of your Internet service provider, which we store for security reasons, after seven days. Otherwise, we delete your personal data as soon as the purpose for which we collected and processed the data ceases to apply. Beyond this point in time, data is only stored to the extent required by law, regulations or other legal provisions to which we are subject in the EU or by legal provisions in third countries, if an adequate level of data protection is provided there. If deletion is not possible in individual cases, the corresponding personal data is marked with the aim of restricting its future processing.

Following contact using the online form, the following deletion periods apply:
a. Contact data is deleted after 5 years. In the event of complaints or liability cases, persons involved must be traceable. This also includes the communication that takes place as part of the processing.

b. Vehicle-related data is deleted after 10 years. There is a legitimate interest in conducting long-term analyses of which vehicle models or model series have triggered the communication within the context of processing.

c. The customer concerns described in the contact form are stored for 5 years. There is a legitimate interest in being able to understand customer concerns.

Deviations from the deletion periods are possible based on national data protection regulations for requests from the following countries:
Argentina, China, Hong Kong, Indonesia, Iceland, South Korea, Singapore, Taiwan, Thailand, Turkey, Ukraine.

Data transfer to recipients outside the European Economic Area.
a. When using service providers (see Section 4. d.) and passing on data with your consent (= agreement) to third parties (see Section 3.c), personal data may be transferred to recipients in countries outside the European Union ("EU"), Iceland, Liechtenstein and Norway (= European Economic Area) and processed there, in particular the USA, India.

b. In the following countries (on the list of countries), from the point of view of the EU, there is an appropriate level of protection for the processing of personal data corresponding to EU standards (so-called adequacy decision). We agree with recipients in other countries on the application of EU standard contractual clauses, binding company regulations or the Swiss-U.S. Privacy Shield in order to create an “adequate level of protection” in accordance with the legal requirements. We will be happy to provide you with information on this using the contact details specified in Section 9.d. above.

c. Data collected as part of the processing of a request using a contact form will be exclusively transmitted by DTAG to the service providers, business partners (local representatives) and internal departments responsible for processing the request.

Freedom of choice.
We would like to use your data to inform you about our products and services and where applicable request your opinion. Naturally, your participation is completely voluntary. Should you not consent, you can inform us at any time so that we can specifically prohibit the use of your data accordingly. Please refer to the respective website for further instructions.

Newsletters.
You may be able to subscribe to newsletters on our website. The data given when registering for a newsletter are only used for sending the newsletter unless you agree to a further use. You can end the subscription at any time via the unsubscribe option in the newsletter.

Social plugins.
Daimler Truck uses what are known as social plugins (hereinafter referred to as buttons) of social networks such as Facebook, Twitter and Google+. During your visit to our website these buttons are deactivated as standard, i.e. without any action on your part they do not send any data to the respective social networks. Before you can use the buttons you must activate them with a click. The button remains active until you deactivate it again or delete your cookies. Following activation a direct link with the server of the respective social network is established. The content of the button is then transferred directly from the social networks to your browser and integrated into the website by it. Following activation of a button the respective social network can already collect data, irrespective of whether you interact with the button. If you are logged-in to a social network it can match your visit to this website with your user account. A social network cannot match a visit to other Daimler websites before you have also activated the corresponding button there. If you are a member of a social network and do not want it to link the data collected during your visit to our website with your stored membership data, you must log out of the respective social network before activating the buttons. We have no influence on the extent of the data which are collected by the social networks with their buttons. Evaluation of usage data & interest-rel. information.
We use Adobe Analytics products in order to be able to detect visitors´ preferences and particularly popular parts of our internet offer. This enables us to provide content that is more accurately suited to your needs, and in so doing improve our service.

We also use what are known as retargeting technologies in order to be able to show you content matching your interests and requirements on Mercedes‑Benz Truck websites of Daimler Truck AG, and authorized sales and service partners, (hereinafter referred to collectively as "Mercedes‑Benz websites"). Your interest in our products and services is stored in cookies to this end. These cookies are processed during a visit to Mercedes‑Benz websites. This takes place in an anonymized fashion, i.e. you cannot be identified through retargeting. Stored cookies are also shared with our financial services partner.

If you do not want Daimler Truck to collect, save and analyze information on your visit and if you do not want to receive information on Mercedes‑Benz websites in line with your interests either you can object to this at any time for the future (opt out).

User-based information (targeting and retargeting).
We also use what are known as retargeting technologies in order to be able to match our online marketing (e.g. banner advertising) more specifically to your requirements and interests on the websites of our retargeting partners (Salesforce DMP, Adobe Target, Flashtalking, Google AdWords, Google DoubleClick and VivaKi). Your interest in our products and services is stored in cookies to this end. These cookies are processed and used when visiting other websites which cooperate with our retargeting partners, in order to be able to provide you with information related as closely as possible to your interests. This takes place in an anonymized fashion, i.e. you cannot be identified through retargeting.

Safety.
Daimler Truck uses technical and organizational security measures in order to protect the data we have under our control against manipulation, loss, destruction and against access by unauthorized persons. Our security procedures are continually enhanced as new technology becomes available.

Freedom of information.
Upon written request, Daimler or its representatives will inform you by letter without delay whether and what personal data are stored by us as defined by applicable legislation. If you are registered as a user, you have the option of viewing, deleting or amending your personal data yourself. Where - despite our efforts to store accurate and current information - incorrect information is being stored by us we will correct the information at your request.
