We appreciate you visiting our website and your interest in the products we offer. Protecting your personal data is very important to us. In this Privacy Statement, we explain how we collect your personal information, what we do with it, for what purposes and on what legal foundation we do so, and what rights you have on that basis. Collecting and processing your personal data.

Whenever you visit our websites, we store certain information about the browser and operating system you are using, whether by clicking links on our websites or entering a domain directly into the input field of the same tab (or window) of the browser in which you have our websites open. No behavioural or vehicle usage data is shared with Mercedes‑Benz Trucks UK. We may share the vehicle location data with third parties instructed to recover the vehicle or with law enforcement agencies in connection with their investigations.

Purpose of use.

We use the personal information collected during your visit to any of our websites to make using them as convenient as possible for you and to protect our IT systems against attacks and other unlawful activities. If you share additional information with us – for example, by filling out a registration form, contact form, chat, survey, contest entry or to execute a contract with you – we will use that information for the designated purposes such as customer management and if required, for processing, billing and business transactions within the required scope in each instance. Transfer of Personal Information to Third Parties; Social Plugins; Use of Service Providers.

We work with various third parties to bring you a range of products and services, which are complimentary to ours. By way of an example, Daimler Truck Financial Services as well as Mercedes‑Benz AG and its affiliates are considered a third party in this context. Our websites may also contain an offer of third parties. If you click on such an offer, we transfer data to the respective provider to the required extent (e.g. information that you have found this offer with us and, if applicable, further information that you have already provided on our websites for this purpose).

When you visit our websites, the social plug-ins are deactivated, i.e. no data is transmitted to the operators of these networks. If you want to use one of the networks, click on the respective social plug-in to establish a direct connection to the server of the respective network. Deleting Your Personal Data.

If we collect your personal information, the length of time we retain it is determined by a number of factors including the purpose for which we use that information and our obligations under applicable laws. We do not retain personal information in an identifiable format for longer than is necessary.

We may need your personal information to establish, bring or defend legal claims, in which case we will retain your personal information for 7 years after the last occasion on which we have used your personal information.

Your IP address and the name of your Internet service provider, which we store for security reasons, are deleted after seven days. Moreover, we delete your personal information as soon as the purpose for which it was collected and processed has been fulfilled. Beyond this time period, data storage only takes place to the extent made necessary by the legislation, regulations or other legal provisions to which we are subject in the EU or by legal provisions in third-party countries if these have an appropriate level of data protection. 3. Where does my data come from and what kind of data is processed?
In accordance with the principles of data avoidance and data minimisation, we only process personal data (“data”) to the extent necessary, to which we are permitted or obliged to do so on the basis of applicable legal requirements, or to which you have consented.

Unless otherwise stated below, the terms “process” and “processing” include in particular the collection, use, disclosure and transmission of personal data (see Article 4 (2) GDPR).

As part of our business relationship with you, we also collect and process certain additional data that is necessary for the fulfilment of our contractual obligations towards you. This includes, but is not limited to:

Data from other sources
We also process personal data that we have received from affiliated companies of Daimler Truck AG and other third parties (e.g. service partners) as permitted – insofar as this is necessary for the performance of the contract or pre-contractual measures concluded with you or if you have consented to this.

We only process personal data from publicly accessible sources (e.g. authorities, the Internet) to the extent permitted by law, for example because this is necessary for the provision of our services or you have consented to this.

4. What is my data used for (purpose of processing) and on what basis (legal basis) is my data used?
Collection and processing as part of the fulfilment of contractual obligations
We collect and process your personal data, specified in more detail in Section 3, as part of the acceptance and performance of our contractual obligations towards you (Article 6 (1) (b) GDPR). For example, we process your contact data for the purpose of contacting you within the framework of the Daimler Truck AG organisation (verification of eligibility for and implementation of breakdown assistance incl. associated processes)

Processing on the basis of legal provisions
In addition, we are subject to extensive legal requirements, for example from the Money Laundering Act or tax laws. Fulfilment of the resulting legal requirements requires the processing of your data (Article 6 (1) (c) GDPR). This processing is particularly for the purpose of sanctions list checks.

Processing based on a legitimate interest
In addition, we process your personal data insofar as this is necessary for the protection of the legitimate interests of Daimler Truck AG or a third party (Article 6 (1) (f) GDPR). This is particularly the case in the following cases:

To the extent necessary for the assertion of legal claims and defence in the event of legal disputes;
To improve the customer experience, we regularly conduct customer satisfaction surveys on our Service24h process. This can be carried out by phone, email or SMS. We ask our customers about previous experiences with Service24h in the event of a breakdown and record suggestions for improvement.

Collection and processing based on a legal obligation
We collect and process your personal data to comply with a legal obligation (legal basis Article 6 (1) (c) GDPR). This is particularly the case in the following cases:

In addition, your personal data will be collected and processed if you have expressly consented to this in advance (Article 6 (1) (a) GDPR).

5. Is my data disclosed (to third parties)?
We do not disclose your personal data to third parties unless you have consented to such disclosure or we are entitled or obliged to disclose data due to legal provisions and/or official or court orders.

Transfer of data to processors
We use processors (e.g. IT service providers) to provide our services. Daimler Truck AG passes on your data to these in strict compliance with the obligation of confidentiality as well as the requirements of the GDPR and the Federal German Data Protection Act. The processors commissioned by us, who may only process the data for us and not for their own purposes, are obliged to comply with the strict standards of Daimler Truck AG.

Transmission to the motor vehicle insurance company
We transmit your data, in particular your first and last name, your address and vehicle data, which we have received as part of your order, to your motor insurance company or its agent, insofar as this is necessary for the assumption of costs.

Transmission to service providers
We use freight forwarders/towing companies/recovery companies to carry out service work. We will transmit to these any of your data necessary for the provision of the service.

Transmission to experts
To ensure order and workshop quality, we employ external experts who need to inspect service orders in order to carry out their work. Only the data that is absolutely necessary for the performance of the activity is transmitted.

6. Will my data be transmitted to a third country or to an international organisation?
Data is not transmitted to countries outside the EU or the EEA (so-called “third countries”), unless we are obliged to do so due to official or court orders.

Exceptional case: As part of Mercedes‑Benz Trucks Service24h, personal data may be transmitted to third countries for the purpose of the performance of the contract on the basis of Article 49 (1)(b) GDPR (depending on the vehicle’s positioning data).

7. Is decision-making automated?
Decision-making is not automated.

8. How long will my data be stored for?
We only process and store your personal data for as long as we need it to fulfil contractual or legal obligations. If there is no longer a legitimate interest, we will delete the data or, if this is not possible, block it. As a rule, we delete your contractual data no later than five years after the end of the contractual relationship.

9. What rights do I have in relation to Daimler Truck AG?
You have extensive rights with regard to the processing of your personal data. It is of particular importance to us that we familiarise you with these rights:

Right to information: You have the right to obtain information about the data stored by us, in particular the purpose of the processing and how long the data is stored for (Article 15 GDPR).
Right to rectification of inaccurate data: You have the right to request that we rectify your personal data immediately if it is inaccurate (Article 16 GDPR).
Right to erasure: You have the right to request that we erase personal data concerning you. These conditions provide that you can request the erasure of your data if, for example, we no longer need the personal data for the purposes for which it was collected or otherwise processed, we should unlawfully process the data, or you should have rightfully objected or withdrawn your consent, or if there is a legal obligation to delete it (Article 17 GDPR).
Right to restriction of processing: You have the right to request restriction of the processing of your data. This right applies in particular for the duration of the verification if you have contested the accuracy of your data, as well as in the event that you request restricted processing instead of erasure if you have an existing right to erasure. Furthermore, processing is restricted in the event that the data is no longer required for the purposes pursued by us, but you need the data for the establishment, exercise or defence of legal claims, and if the successful exercise of an objection between us and you is disputed (Article 18 GDPR).
Right to data portability: You have the right to receive the personal data concerning you that you have provided to us from us in a structured, commonly used, machine-readable format (Article 20 GDPR), insofar as this has not already been deleted.

10. Can I withdraw consent to data processing that I have already given?
You can withdraw your consent to the processing of personal data at any time, free of charge and with future effect. This also applies to declarations of consent issued before the entry into force of the EU General Data Protection Regulation, i.e. before 25 May 2018.

11. Can I object to the processing of my personal data?
You have the right to object to the processing of personal data concerning you at any time for reasons arising from your particular situation (Article 21 GDPR). We shall no longer process your personal data unless we can demonstrate compelling, legitimate grounds for the processing which override your interests, rights and freedoms, or if the processing serves to establish, exercise or defend legal claims.

The revised UK Corporate Governance Code places several obligations on Company Directors. This includes the requirement for Directors to consider long-term effects of decision made on a wide stakeholder group and the environment in which the company operates. On top of this, there is a clear requirement to consider the fair treatment of everyone associated with the Company.

Long Term Decisions.

Naturally, the Directors take a long-term view in all their decision making, and decisions are done with the future goals of the Company in mind. As seen in the Daimler Sustainability Report, the industry landscape is changing, and Directors decisions have to take into account the United Nations’ Sustainable Development Goals. These include ever-improving working and living conditions across the World, as well as prioritising the electrification of our vehicles with a UK target to have a carbon-neutral truck fleet by 2039.

Culture.

The Directors recognise that they have an important role in ensuring that the desired culture is reflected in the values, attitudes, and behaviours demonstrated throughout the Company. The Directors have established respect, passion, discipline and integrity as the four core values. Within the Company there are three culture theme groups, namely Feedback Culture, Career Rotation and Development, and Purpose.

Sustainability.

Sustainability is a crucial factor that the Directors recognise as influential in the worldwide corporate domain, particularly in the motor industry. This is driven by six key themes; Climate Protection & Air Quality, Resource Conservation, Liveable Cities, Traffic Safety, Data Responsibility, and Human Rights. The Company recognises three enablers for these themes, which focus on key stakeholder groups. The firstly, Integrity, which is achieved by strengthening trust and relationships by remaining compliant with laws and regulations. This statement is made pursuant to the Modern Slavery Act 2015 and sets out what steps Mercedes-Benz Trucks UK Ltd has taken and continue to take in order to prevent modern slavery and human trafficking from taking place within our business and our supply chain.

Structure and Business

Mercedes-Benz Trucks UK Ltd (“the Company) is part of the Daimler Truck Group under Daimler Truck AG. The Company’s principal activities relate to importing, storage, marketing and distribution of Mercedes-Benz Truck and Fuso products in the United Kingdom. For the Company, the respect for human rights is a fundamental component of responsible corporate governance. We are committed to ensuring that human rights are respected and upheld in our business and by our suppliers.

Policies

We are committed to our social responsibilities, which include respecting human rights, respecting the rights of employees and their representatives, protecting the environment, enabling fair competition and fighting against corruption.

Our company Integrity Code sets out our corporate responsibilities as well as the rules and values by which all employees should be behave. Examples include but are not limited to:

Treating one another with fairness and respect. This is applicable for our employees, customers and business partners alike, which includes suppliers.
Working with integrity and transparency such as protecting human rights.
Compliance with legislation, including fundamental rights at work - in particular freedom of association and elimination of discrimination throughout employment.

Employee Training

Training is carried out on both a Group level and local level with a selection of subjects from integrity in general to compliance in procurement and sustainability.

We conduct on-line and face-to-face training for all employees to emphasise the importance of acting with integrity in line with ethical business practices.
Social compliance training is completed by those employees in relevant functions.
Suppliers and Business Partners have access to a Compliance Awareness Module web training which provides an overview of various governance topics including selection of business partners through due diligence, values, corruption risk awareness and business partner responsibilities.

The Company disciplinary policies permit the termination of employees found to be involved in any breach of the law banning forced labour, slavery and human trafficking. Policies and procedures will continue to be updated as required to ensure that appropriate safeguards are maintained against any mistreatment of persons involved in the supply chains or own businesses.

Supply Chain and Due Diligence

The Company maintains written policies that strictly prohibit the use of slavery or human trafficking in the direct supply chains. The company brochure Daimler Business Partner Standards sets out ethical principles and associated expectations and is communicated to the supply chain. The supplier code of conduct requires all suppliers to the Company to sign up to a sustainability clause, which details the requirements around forced labour, slavery and human trafficking. When a supplier signs up to the sustainability clause, it receives official certification to this effect. By this certification, the suppliers that the Company interacts with confirm they will adhere to the guidelines and expectations set out, focusing on but not limited to “Child Labour Avoidance”, “Freely Chosen Employment”, and “Freedom of Association” in line with the Modern Slavery Act. This agreement is mandatory and the Company does not deal with suppliers who do not sign up to this clause.

Mercedes-Benz Trucks UK Ltd has a zero tolerance policy towards violations of the laws banning forced labour, slavery and human trafficking. Our contractual agreements give us the right to audit suppliers at any time for compliance with the sustainability clause and permit the termination of suppliers for a single violation.

The Daimler Truck Group entities periodically undertake Human Rights Compliance Assessments to ensure that all areas of the business are compliant with the ethical practises and international human rights standards, and that all employees are treated in a fair and transparent manner. This includes adherence to the Working Time Directive and the Minimum Wage.

The following data protection notices provide data subjects with an overview of the processing of personal data by Daimler Truck AG in connection with the processing of video, image and audio data as part of Daimler Truck research, development and testing processes for driving assistance systems, automated driving, driving functions and other services. Personal data means any information relating to an identified or identifiable natural person.

With this data protection notice, we inform data subjects about the type, scope and purpose of the processing of personal data and how we handle this data as part of the above-mentioned research, development and testing processes. In addition, data subjects are informed of their rights with regard to the processing of personal data.

1. To whom does this data protection notice apply?
In this document, we inform data subjects about the protection of personal data when recording, processing and storing video, image and audio data in and from public traffic and – to the extent permitted by other law – on private plant, test and other premises. This data is collected by specially marked test vehicles of Daimler Truck AG for the purpose of carrying out research, development and testing in the context of driving assistance systems, automated driving, driving functions and other services. Any person in the vicinity of one of the marked test vehicles during test operation is potentially affected by this data processing.

2. Who is responsible for the processing of the data and who can data subjects contact regarding data protection?

3. Where does the data come from and what kind of data is processed?
As part of the above-mentioned research, development and testing processes, marked test vehicles take part in public traffic and – to the extent permitted by other law – on private plant, test and other premises. The vehicles are equipped with camera systems featuring different detection directions, focal lengths and sensor technologies, as well as, in some cases, with exterior microphones and other sensor systems. These systems collect, process and store video, image and audio data from the vehicle environment for the purposes described in section 4 of this data protection notice.

Depending on the individual case, this data may also contain the following personal information:

Faces, other characteristics as well as behaviour and environment of road users and other persons in the vicinity of the test vehicles
Licence plates, other features and surroundings of vehicles and other objects in the vicinity of the test vehicles
Audible information from the area around the test vehicles
Additional data from other sensor systems (such as radar, LIDAR) as well as GPS position and time stamp of data acquisition

4. What is the data used for (purpose of processing) and on which basis (legal basis) is the data used?
The purposes of this type of data processing are research, development and testing in the context of driver assistance systems, automated driving (including automated plant traffic), driving functions and other services, including documentation of these processes and fulfilment of other downstream obligations.

Driving assistance systems and driving functions are already used in current vehicles to increase road safety in particular, but also comfort and convenience. In future automated and autonomous vehicles, technical systems for perceiving and managing traffic and environmental situations will enable the compliant and safe participation of such vehicles in public traffic. Other services make it possible to make means of transport, traffic and transport systems safer, more efficient and more convenient.

For the purposes of research, development and testing of such systems, they must be used in test vehicles under real environmental and traffic conditions – including in public traffic – and including the recording, processing and storage of video, image and audio recordings during and after these operations. This data is used to research, develop and test technical systems for the recognition and classification of road users, vehicles, infrastructure and other objects in their surroundings and in the context of traffic situations.

Persons, vehicles, other objects and audio information are only analysed, classified and further processed as "objects" in their surroundings and in the context of traffic situations as part of the data processing; i.e. as "pedestrians at the right edge of the road", "cars at a crossroads", "Emergency services signal behind the vehicle", for example. Named or other personal identification of recorded persons or assignment of recorded vehicles or objects to such identified persons is therefore neither necessary nor planned within the scope of the processing carried out, and is usually also not possible. However, since the required raw data consists of video, image and audio material, the identifiability and identification of persons cannot be excluded.

The primary legal basis for processing is the "protection of legitimate interests" pursuant to Art. 6 Paragraph 1 p.1 lit. f GDPR. The legitimate interest of Daimler Truck AG here is the research, development and testing on driver assistance systems, automated driving, driving functions and other services.

The conflicting interests, fundamental rights and fundamental freedoms of data subjects do not prevail, as the identification of individual data subjects by name or other personal identification is neither necessary nor intended and is usually not possible. Technical and organisational measures are also taken to ensure that the data collected is processed in accordance with data protection regulations.

5. Is the data disclosed (to third parties)?
Daimler Truck AG only discloses this data to cooperation partners, processors or third parties within the scope of the purpose limitation under data protection law. Disclosure will only take place insofar as it is permitted on the basis of legal provisions and/or official or court orders or if the legitimate interest involves the third party.

Categories of recipients to whom data may be disclosed to in the context of processing within the context of this document are in particular:

Group-internal and external cooperation partners of Daimler Truck AG as part of research and development processes
Suppliers as part of research and development processes
Other processors (in particular IT service providers and service providers for data processing/data evaluation)

If disclosure to recipients in third countries takes place as part of the research, development and testing processes or downstream processing, this will only take place following an adequacy decision in accordance with Art. 45 GDPR, on the basis of appropriate safeguards as per Art. 46 GDPR or if permitted by other law.

6. Is decision-making automated?
There is no automated decision-making in individual cases or profiling as per Art. 22 GDPR.

7. How long will the data be stored?
The video, image and audio data will be processed and stored for as long as necessary for the above-mentioned research, development and testing processes. If there is a further legal basis or a further legitimate interest for further storage and processing (e.g. for the proper documentation of the aforementioned processes, due to legal retention obligations or other legal requirements), the data will be stored for a correspondingly longer period.

8. What rights do data subjects have in relation to Daimler Truck AG?
As part of the processing of personal data, data subjects have the following rights. With regard to the exercise and restrictions of these rights in the context of the processing described here, please also observe the respective special notes on this.

Special notes on exercising the rights of data subjects:
This data protection notice relates to processing for which identification of the data subject is not required in accordance with Art. 11 GDPR. Beyond the recorded video, image and audio data, no additional identification characteristics of data subjects are regularly processed.

The exercise and fulfilment of data subject rights will therefore often require further information from the data subject – depending on the individual case – in particular information about the LOCATION and TIME at which the data subject may have been affected by the processing (i.e. information about when and where you were specifically in the vicinity of one of the test vehicles). This additional information may be necessary in order to determine whether a specific person is affected by the processing and in order to exercise the rights mentioned below, such as access, deletion, etc.

Right ofaccess: Data subjects have the right to request information as to whether personal data concerning them is being processed by us. Insofar as data is processed, data subjects have the right to access this data as well as information on the modalities of processing in accordance with Art. 15 GDPR.
Right to rectification of inaccurate data: Data subjects have the right to request that we correct personal data concerning them. This right can generally only be implemented for video, image and audio data by deletion.
Right to erasure: Data subjects have the right to request that we erase personal data concerning them.
Right to restriction of processing: Data subjects have the right to request restriction of the processing of their data.
Right to lodge a complaint with a supervisory authority: Data subjects have the right to lodge a complaint with a supervisory authority, for example with the data protection authority responsible for their place of residence, workplace or for the place of the possible data protection breach.
Right to object: Data subjects have the right to object to the processing of their personal data.

Special notes on the limitation of data subject rights:
Please note that, in the context of this processing, the rights of data subjects under Art. 15 GDPR (right to access), Art. 16 GDPR (right to rectification), Art. 17 GDPR (right to erasure), Art. 18 GDPR (right to restriction of processing) and Art. 21 GDPR (right to object) may be subject to special, additional restrictions. These specific restrictions apply where the exercise and fulfilment of these rights in a specific case would be likely to severely impair the achievement of research purposes or make this impossible, and the restriction is therefore necessary for the fulfilment of those research purposes. This particular restrictability and its prerequisites arise in particular from Art. 89 GDPR in conjunction with Section 27 BDSG (German Federal Data Protection Act) and Art. 17 GDPR.

Terms and Conditions of Use for the RoadStars communication platform.

Community

User profiles, pinboards, comments and social logins form part of the Community at “RoadStars”. All of these activities offer users the opportunity to exchange ideas with each other. This means that:

- Users can create a profile

- Users can exchange information in comments and on pinboards

- Users can upload images to pinboards and share them with other users

- Registered and logged-in users can access exclusive content

- Users can comment on exclusive posts on the platform

- Users can log in to the platform using their user data from other social networks

RoadStars members benefit from special bonus campaigns that are specifically aimed at the target group of truck drivers. Examples of these include vehicle tests, product surveys, driving safety training courses or other special truck driver events.

The campaigns themselves will be announced on the website. The invitation and detailed information about the respective event will be sent by email. The overall package of bonus offers for registered members therefore includes, to the extent necessary, direct contact with the target group in order to invite them to campaigns, communicate detailed event information and send, for example, thank-you packages after campaigns or small gifts at Christmas or after driver registration. First name, surname and addresses (email and postal address) are required for this.

Names and addresses will not be shared with other community members.

1. Scope of application

The following Terms and Conditions of Use govern the relationship between Daimler Truck AG as a provider of RoadStars (hereinafter referred to as the “Provider”) and the Users of the Community.

Use of the Community is only permitted if the User accepts these Terms and Conditions of Use.

2. Registration

(1) A prerequisite for using the Community is prior registration. By registering, you accept these Terms and Conditions of Use.

(2) The User is obliged to provide the mandatory information required during registration truthfully. All mandatory fields must be completed.

(3) The User may not pass on their login details to third parties for use. The User is obliged to keep their login data confidential and to protect it from being accessed by third parties. In addition, the User may only create a single personal profile.

(4) Membership of the Community is only possible from the age of 18. There is no entitlement to registration or membership.

3. Services of the Provider

(1) The Provider authorises the User to publish posts on its website within the framework of these Terms and Conditions of Use. To this end, the Provider shall provide the Users with a communication platform with community functions free of charge within the scope of its technical and economic possibilities. The Provider shall endeavour to keep its service available. The Provider does not assume any further performance obligations. In particular, the User shall not have any claim to the permanent availability of the service. Maintenance work, further development or malfunctions may restrict or temporarily interrupt the possible uses.

(2) The Provider assumes no liability for the accuracy, completeness, reliability, up-to-dateness and usability of the content provided.

4. Exclusion of liability

(1) Claims for damages by the User are excluded, unless otherwise stipulated below. The foregoing exclusion of liability also applies to the legal representatives and vicarious agents of the Provider insofar as the User asserts claims against them.

(2) The exclusion of liability stipulated in Paragraph 1 excludes claims for damages due to injury to life, limb or health and claims for damages due to the breach of essential contractual obligations. Essential contractual obligations are those whose fulfilment is necessary to achieve the objective of the contract. The exclusion of liability also excludes liability for damages that are based on an intentional or grossly negligent breach of duty by the Provider, its legal representatives or vicarious agents.

5. Obligations of the User and illegal content

(1) The User is solely responsible for any content posted by them.

(2) The Community is intended exclusively for private use. The User undertakes not to publish any commercial content.

(3) The User undertakes to the Provider not to publish any posts that violate moral standards or applicable law.

(4) In particular, the User undertakes not to publish any posts whose publication constitutes a criminal or administrative offence.

(5) It is prohibited to post content whose publication/distribution via RoadStars infringes the rights of third parties (in particular copyright, trademark, name and identification rights, right to own image) or which is threatening, offensive, defamatory, racist, glorifying violence, grossly offensive, harassing, discriminatory, pornographic or unsuitable for underage persons.

(6) In particular, the User must observe the personal rights of third parties with regard to the content they post. For example, the User is responsible for ensuring that the persons depicted in their images have given their consent – insofar as such consent is required by law – for publication.

(7) In the event of a breach of these obligations, the Provider is entitled to amend or delete the relevant posts. We reserve the right to block the account and terminate the membership of any User who has posted this content. The User is obliged to compensate the Provider for any damage caused by the breach of duty.

(8) The Provider has the right to delete posts and content if they could contain a legal violation.

(9) The Provider shall be entitled to indemnification against the User against claims by third parties asserted due to the infringement of a right by the User. The User undertakes to support the Provider in defending against such claims. The User is also obliged to bear the costs of the Provider's appropriate legal defence.

(10) The User is not entitled to post content or repost content that has already been deleted or blocked.

7. Transfer of rights of use/copyright provisions

(1) The copyright for uploaded posts remains with the respective User. However, by uploading its posts to the Community, the User grants the Provider the right to keep the post permanently available for access on its website. The Provider may make the content posted by the User publicly available free of charge and without restriction in terms of content, time and location and may reuse it within the website and, if necessary, further process it and combine it with other content.

(2) The User guarantees that they are the owner of all rights to the posted content required for the aforementioned uses and/or that they can dispose of these rights, and that these uses do not infringe any third-party rights or legal provisions.

(3) The User has no claim against the Provider for the deletion or correction of posts created by them.

8. Termination of membership

(1) The User may terminate their membership at any time by sending an informal email to roadstars@mercedes-benz-trucks.com. The resulting deletion of data does not include posts, comments and messages that you have published or written on the platform before this point in time or data which we are legally obliged or entitled to retain. After deletion of your user account, we reserve the right to anonymise the posts, comments and messages you have published or written on the platform before this point in time.

(2) The Provider is entitled to terminate a User's membership, e.g. if the User violates the Terms and Conditions of Use or has not logged in for a period of twelve (12) months.

(3) The Provider is entitled, but not obliged, to delete the content created by the User in the event of termination of the membership. The User's claim to the transfer of the created content is excluded. The granting of rights by the User in accordance with Clause 7 shall remain unaffected for an indefinite period.

9. Changes to the Terms and Conditions of Use/changes to the offer

(1) The Provider is entitled to make changes to its service or to discontinue the service.

(2) The Provider reserves the right to change these Terms and Conditions of Use with effect for the future. In this case, we will inform you in advance of the changes and point out that the changes will be deemed accepted if you do not object to the changes within thirty (30) days or as soon as you use the platform again. 10. Responsibility

(1) The responsibility for all comments, texts, information, data, software, sounds, images, photos, graphics, videos, messages or other materials (“Content”) stored, published or transmitted by you or other Users using the platform rests exclusively and without limitation with the person who made the Content available on the platform.

(2) The User ensures that they have all necessary rights to all Content made available by them on the platform, have unrestricted usage rights to this and do not preclude any rights of third parties. Should third parties nevertheless assert claims due to the infringement of their rights, the User shall indemnify Daimler Truck AG against all claims in this context. The indemnity shall also cover the costs of appropriate legal defence.

11. Data protection

The Provider collects, processes and uses the User's personal data in accordance with these Terms and Conditions of Use for the purpose of providing the Community and its functions, and to the extent that the User consents to its further processing and use. Please also observe our data protection information.

12. Other

(1) The legal relationship between the Provider and the Users is governed by the law of the Federal Republic of Germany.

(2) To the extent permitted and compatible by law, Stuttgart shall be the place of performance and the exclusive place of jurisdiction.

(3) Any invalidity of one provision of these Terms and Conditions of Use shall not affect the validity of the remaining Terms and Conditions of Use.
